Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Recruiter website and platform (“Recruiter”), provided by ERP Tohama Co., Ltd. (“ERP Tohama”, “we”, “us”). By applying for or using Recruiter you agree to these Terms. If you apply on behalf of a company, you confirm that you are authorized to bind that company.

Recruiter is for recruitment professionals and recruitment companies. Access is given only after we verify you and, for companies, after a Memorandum of Understanding (MoU) is signed.

You must give accurate information, keep it up to date, and complete the compliance and Information Security Training we ask for before you access the platform.

Recruiters are never charged to apply, join or use Recruiter.

We will not ask you for money to be verified, to receive credentials or to access the platform. If anyone asks you for payment in our name, please tell us through the form on our home page.

We send your access credentials separately and securely. You are responsible for keeping them confidential and for all activity under your account.

Do not share your login, and tell us straight away if you think someone else has used it.

You may use Recruiter only for authorized recruitment activity, and only with the opportunities and candidate information that the platform makes available to you.

You must not:

• copy, scrape or resell platform data;
• contact candidates or employers outside the authorized process;
• submit false or misleading information;
• try to bypass security controls;
• use the platform for anything unlawful or discriminatory.

Candidate information is shown only where it is authorized and needed. You must handle it according to our Privacy Policy, our Information Security Policy and the applicable data protection laws, and use it only for the recruitment purpose it was shared for.

Commissions are paid within 5 days of the client’s payment.

Commissions on qualifying placements are set in the commercial terms that apply to each assignment. Assignment availability and income are not guaranteed.

Recruiter uses AI to suggest matches. Suggestions are a starting point only: recruiters review and recommend, and employers make the final hiring decision. We do not promise that any suggestion is complete or error-free.

Recruiter, its software, design, text and logos belong to ERP Tohama or its licensors. You receive a limited, personal, non-transferable right to use the platform while your access is active. Content you submit remains yours, and you give us the right to use it to run Recruiter for you.

We may suspend or end access if these Terms are broken, if verification cannot be completed, if security is at risk or if the law requires it. You may stop using Recruiter at any time and ask us to close your account (see Account and Data Deletion).

We work hard to keep Recruiter available and accurate, but it is provided “as is”. To the extent the law allows, ERP Tohama is not liable for indirect or consequential loss, or for loss caused by events outside our reasonable control. Nothing in these Terms limits liability that cannot lawfully be limited.

We may update these Terms. We will post the new version here with a new date, and tell you about important changes. Using Recruiter after a change means you accept it.

These Terms are governed by the laws of Kenya.

The courts of Kenya have jurisdiction, unless a signed agreement with you says otherwise.
